Berg v. Obama is a civil action filed by Philip Berg against Barack Obama, as well as the Democratic National Committee, Federal Election Commission, and others.

The case abstract is:

Plaintiff Philip J. Berg alleged that Defendant Barack Obama is not eligible for the Office of the President because Obama lost his U.S. citizenship when his mother married an Indonesian citizen and naturalized in Indonesia. Plaintiff further alleged that Obama followed her naturalization and failed to take an oath of allegiance when he turned 18 years old to regain his U.S. citizenship status.[1]

The Philadelphia Daily News notes: "Under the law, however, moving to a foreign country does not negate an American's citizenship."[2]

The case was filed in Pennsylvania Eastern District Court on August 21, 2008, and is still pending resolution.
