The NAI Code and Enforcement Program: An Overview
The NAI Code of Conduct, is a set of self-regulatory principles which all NAI member companies must agree to uphold in order to be members. The Code requires varying forms of notice and choice with respect to Tailored Advertising and Ad Delivery and Reporting, places limits on the types of data that member companies can use for advertising purposes, and imposes a host of substantive restrictions on member companies’ collection, use, and transfer of data used for Tailored Advertising. Learn more about the NAI Self-Regulatory Code of Conduct. To help ensure that members abide by the NAI Code, the NAI has a robust compliance program, including sanctions mechanisms. The NAI has temporarily paused enforcement of the Code as of July 1, 2023 in order to draft new governing guidelines that more accurately reflect state legal requirements.
