2024 marks the ten-year anniversary of the European Commission’s Damages Directive (2014/104/EU). What have we learned in that time? Evidence from economic analysis should help courts compensate claimants sufficiently for the harm they have suffered from anti-competitive conduct. The Damages Directive has helped improve the evidence available to court. But challenges remain.
